These Terms of Service govern access to and use of the educational platform VitaPlena, available through the domain vitaplena.net and/or a temporary address of the *.netlify.app type until the primary domain is activated.
VitaPlena is a bilingual educational platform in Bulgarian and English, dedicated to oncology nutrition. The platform is created and personally run by Ana-Marina Bogdanova, a 4th-year medical student.
Please read these Terms of Service carefully before using the site. By accessing the site or using any VitaPlena functionality, you confirm that you have read and agree to comply with them.
1. Platform and controller information
1.1. VitaPlena is a website and educational online platform, created and personally run by Ana-Marina Bogdanova, a private individual based in Bulgaria.
1.2. VitaPlena isn't a medical facility, medical center, telemedicine platform, registered medical service provider, or a company providing medical activity.
1.3. The controller can be contacted through the contact form published on the site, or through another contact listed on the site.
1.4. Where these Terms of Service use the expressions "VitaPlena," "the platform," "the site," "we," or "the controller," they refer to the platform described above and the person who runs it, unless the context indicates otherwise.
2. Subject matter and scope
2.1. These Terms of Service apply to all visitors and users of the site, including people who view publicly available content, submit a community access request, or, following future activation, use registration and/or a paid subscription feature.
2.2. The platform provides educational content related to nutrition in oncological disease, based on scientific and professional sources, including but not limited to ESPEN, ASCO, and publications available through PubMed.
2.3. These Terms of Service don't govern the provision of medical services, diagnosis, treatment, individual dietary regimens, individual medical recommendations, or emergency medical care.
2.4. Processing of personal data in connection with the site is governed by VitaPlena's separate Privacy Policy, which should be read together with these Terms of Service.
3. Medical disclaimer
3.1. VitaPlena's content is purely informational and educational in nature. It doesn't constitute medical advice, medical consultation, diagnosis, treatment, prescription, dietary regimen, treatment plan, or a recommendation tailored to any individual's health condition.
3.2. The information on the site doesn't replace consultation with a doctor, oncologist, clinical dietitian, pharmacist, or other qualified medical professional. Users shouldn't start, change, discontinue, or delay treatment, a dietary regimen, or the use of medication or supplements based solely on content published on VitaPlena.
3.3. For questions about diagnosis, treatment, side effects, nutrition during therapy, weight loss or gain, symptoms, emergencies, or other medical circumstances, users should consult a qualified medical professional.
3.4. VitaPlena isn't liable for decisions, actions, or omissions by users based on their own interpretation of published content, where the user hasn't sought professional medical consultation.
3.5. Any article on the site may include its own disclaimer. In the event of a conflict between a specific article's disclaimer and this section, the stricter limitation regarding the medical nature of the content applies.
4. Target audience and age restriction
4.1. The site is intended primarily for the following groups of users:
- cancer patients;
- their families, caregivers, and people supporting them;
- medical professionals, including oncologists, dietitians, and other professionals interested in oncology nutrition.
4.2. The site isn't directed at children under 16. People under 16 shouldn't submit data through the site's forms or use interactive features without the knowledge and consent of a parent or legal guardian.
4.3. If the controller determines that data has been provided by a person under 16 without the required consent, it may take action to restrict access and delete the relevant data in accordance with the Privacy Policy.
5. Site content
5.1. VitaPlena publishes articles, materials, and other educational resources on topics related to oncology nutrition.
5.2. Some content may be marked as free, and other content as paid or intended to require subscription access, once such functionality is activated.
5.3. As of the date of this version, the paid functionality isn't activated for visitors, and the site operates with free content only, without requiring registration.
5.4. The controller makes an effort to keep content accurate, current, and based on reliable sources, but doesn't guarantee that every publication is exhaustive, error-free, or applicable to any individual user's condition.
5.5. The controller may, at any time, add, change, temporarily restrict, or remove content from the site, including when necessary due to a scientific update, technical reasons, legal review, or a change in the platform's functionality.
6. Future registration and user account (inactive functionality)
6.1. As of the date of this version, the site doesn't require registration or a user account — all free content is accessible without one. If registration functionality is introduced in the future (for example, in connection with the community or a paid subscription), this section will be activated and expanded, and users will be notified before it's introduced.
6.2. If registration is introduced in the future, users will be required to provide a current email address and not use someone else's identity, email address, or data that could mislead the controller or other people.
6.3. Once registration is activated, passwords will be stored in hashed form and won't be stored by VitaPlena as readable text. Users will be responsible for keeping their access credentials confidential.
6.4. Once registration is activated, users should immediately notify the controller through the site's contact form if they suspect unauthorized access to their account.
6.5. Once registration is activated, users will be able to request deletion of their account at any time by contacting the controller. Processing of the request and the consequences of deletion will be further governed by the Privacy Policy.
6.6. The controller will be able to restrict or terminate access to an account in the event of a breach of these Terms of Service, misuse of the site, an attempt at unauthorized access, circumvention of technical restrictions, or other conduct that endangers the platform, the controller, or other users.
7. Community access request
7.1. VitaPlena may offer the option to submit a request for access to a closed, moderated community for patients and families.
7.2. Access to the community is by invitation and isn't granted automatically. Submitting a request doesn't guarantee approval, inclusion in the community, or access to future functionality.
7.3. The request form may collect a name, an email address, and optional free-form text about why the user wants access. Submitting a request doesn't require registration or a user account.
7.4. Requests are reviewed personally by the controller. No automated approval of access is used.
7.5. The community itself, including the platform on which conversations will take place, participation rules, moderation, and additional terms of use, is yet to be determined. Once such a community is activated, separate rules or an addendum to these Terms of Service may apply to it.
7.6. The community, if activated, shouldn't be used for emergency medical questions, diagnoses, individual treatment decisions, or as a substitute for professional medical consultation.
8. Paid content and subscription functionality (inactive)
8.1. As of the date of this version, VitaPlena's paid subscription functionality is disabled for visitors. The site operates with free content only, until it's explicitly activated.
8.2. The platform is technically built to support a future paid subscription, including a "Community" feature or access to additional content, through Stripe as an external payment services provider.
8.3. Once paid functionality is activated in the future, the terms regarding price, subscription period, included content, payment method, renewal, cancellation, termination, and any promotional terms should be clearly stated on the site before payment is made.
8.4. The subscription may be monthly or yearly, with automatic renewal until cancelled by the user, if this is explicitly stated at the time of order and confirmed by the user.
8.5. Users may cancel future subscription renewal at any time through the mechanism provided for that purpose or by contacting the controller. Upon cancellation, access to the paid functionality remains active until the end of the already-paid period, unless the site states otherwise or applicable law requires differently.
8.6. Before paid functionality is activated, this section should be reviewed and, if necessary, supplemented with specific rules on the user's right of withdrawal, refunds, digital content, commencement of performance, and applicable exceptions.
9. Payments through Stripe upon future activation
9.1. Once paid functionality is activated in the future, payments will be processed by Stripe or another explicitly named payment services provider.
9.2. Users' card details won't be stored on VitaPlena's servers and won't be accessible to the controller in full form.
9.3. For subscription management purposes, VitaPlena may store an email address, subscription status, and Stripe customer and/or subscription identifiers, to the extent necessary to provide access, accounting, customer service, and compliance with legal obligations.
9.4. Payments, cancellations, failed payments, renewals, and billing may also be subject to Stripe's own terms, when the user is redirected to or uses Stripe's payment infrastructure.
9.5. VitaPlena isn't liable for interruptions, declined transactions, delays, or technical issues that arise entirely from the external payment provider's systems, except to the extent applicable law provides otherwise.
10. Acceptable use rules
10.1. Users agree to use the site in good faith, lawfully, and in accordance with its educational purpose.
10.2. Users may not:
- use the site for unlawful, fraudulent, harmful, or misleading purposes;
- attempt unauthorized access to systems, servers, data, or administrative panels;
- circumvent technical restrictions, access mechanisms, or future paid-content mechanisms;
- copy, extract, scrape, or systematically reproduce content from the site beyond permitted personal use;
- use the content to provide medical advice to third parties in a way that creates the impression that VitaPlena is a medical provider or that the content constitutes an individual recommendation;
- submit false, misleading, someone else's, or outdated data through the site's forms.
10.3. In the event of a breach of this section, the controller may restrict access, deny a community access request, or take other reasonable technical and organizational measures to protect the platform.
11. Intellectual property
11.1. All texts, articles, structure, selection of materials, design, graphic elements, names, logos, and other elements of the site are subject to intellectual property rights of the controller or the respective rightsholders, unless explicitly stated otherwise.
11.2. Users may use the site's content only for personal, non-commercial, informational, and educational purposes.
11.3. Without the controller's prior written consent, reproduction, publication, translation, adaptation, distribution, public display, commercial use, or systematic extraction of content from the site isn't permitted, except within the limits allowed by applicable law.
11.4. References to scientific sources, organizations, databases, or publications in the site's content don't imply that those third parties endorse, sponsor, or are liable for VitaPlena, unless explicitly stated.
12. Personal data, hosting, and cookies
12.1. When using the site in its current free version, personal data voluntarily submitted through a community access request form or the contact form may be processed. Once registration and/or paid functionality is activated in the future, an email address, hashed password, and subscription status data may additionally be processed.
12.2. Community access requests and contact messages are stored via Netlify Forms, as part of the hosting provider Netlify's technical infrastructure. Once registration is activated in the future, accounts may be stored via Netlify Blobs.
12.3. Once payments are activated in the future, Stripe will process payment information as an external payment services provider. Card details aren't stored by VitaPlena.
12.4. As of the date of this version, the site doesn't use login or session cookies, since registration isn't required. If registration is introduced in the future, a corresponding technical cookie will be added, and the Privacy Policy will be updated in advance.
12.5. Detailed information regarding the personal data controller, purposes, legal bases, retention periods, data subject rights, processors used, and contacts for exercising rights should be set out in VitaPlena's Privacy Policy.
13. Limitation of liability
13.1. VitaPlena provides the site and its content in the condition available at the relevant time, without warranty of continuity, absence of technical errors, or full compatibility with any device, browser, or configuration.
13.2. The controller isn't liable for damages arising from using the content as a substitute for professional medical consultation, from independently applying general information to an individual health condition, or from not seeking medical help.
13.3. The controller isn't liable for the content, services, terms, policies, or actions of third parties, including Stripe, Netlify, or external sites and sources to which VitaPlena may link.
13.4. Nothing in these Terms of Service excludes or limits liability that can't be excluded or limited under applicable law.
14. External links and scientific sources
14.1. The site may contain links to external sources, scientific publications, professional organizations, databases, payment pages, or other third-party websites.
14.2. External links are provided for convenience and informational value. VitaPlena doesn't control the content, availability, privacy policies, terms of use, or practices of external sites.
14.3. Users should independently review the terms and policies of the relevant external sites before using them or providing data through them.
14.4. Referencing a scientific source doesn't constitute a medical recommendation to any specific user and doesn't imply that the source is applicable to every clinical situation.
15. Language, territorial scope, and applicable law
15.1. VitaPlena's content and functionality may be available in Bulgarian and English.
15.2. The controller is based in Bulgaria. The expected audience is mostly in Bulgaria, while the English version of the site may also be accessible to international visitors.
15.3. Unless mandatory rules of applicable law provide otherwise, these Terms of Service are interpreted in accordance with the law of the Republic of Bulgaria.
15.4. In the event of a discrepancy between the Bulgarian and English language versions of the Terms of Service, it's recommended that the final version specify which language version prevails. Until this matter is explicitly settled, the text should be reviewed legally before publication.
16. Changes to these Terms of Service
16.1. The controller may amend these Terms of Service when necessary due to changes in the site's functionality, activation of registration or paid content, introduction of a community, a change of providers, technical changes, legal requirements, or other objective reasons.
16.2. The current version of the Terms of Service is published on the site with a date or version indicated.
16.3. For material changes affecting future registered users or paid subscribers, the controller may notify users through the site, by email, or through another appropriate channel.
16.4. Continued use of the site after the changes are published constitutes acceptance of the amended Terms of Service, unless applicable law requires explicit consent.
